In short

  • You agree to a legally binding contract that requires you to resolve all disputes with Uber through private arbitration instead of going to court.
  • You waive your right to a jury trial and are not allowed to join or start class-action lawsuits against the company.
  • The agreement also allows Uber to change the terms at any time, with your continued use serving as consent to those changes.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve all claims and disputes with Uber in individual binding arbitration rather than in court.

    This product

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration... and not as a class, collective, coordinated, consolidated, mass and/or representative action.”
  2. 02

You are agreeing to give up your right to have a jury trial on your claims against Uber.

    This product

“IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”
  3. 03

You are agreeing to allow Uber to modify these Terms at any time, with your continued use constituting acceptance of those changes.

    This product

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms through the Services or Uber’s website. ...your continued use of the Services after any such changes constitutes your agreement to such changes.”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to bypass the public court system for all disputes except very limited exceptions.

“This Arbitration Agreement will preclude you from bringing any class, collective, coordinated, consolidated, mass, and/or representative action against Uber... Thus, the parties agree that the Arbitrator shall not conduct any form of class, collective, coordinated, consolidated, mass, and/or representative arbitration...”

What that means: You cannot join other users in suing Uber for shared issues, which reduces leverage and increases individual legal costs.

The document forces all users into individual binding arbitration for any dispute, explicitly waiving the right to participate in class actions or mass arbitrations.

High cost

Jury trial or court access waived

You are agreeing to forfeit your right to a jury trial for any claims covered under these terms.

“You and Uber are each waiving your right to a jury trial. ...PLEASE READ THESE TERMS OF SERVICE CAREFULLY AS THEY CONTAIN PROVISIONS THAT GOVERN HOW YOU CAN BRING CLAIMS AND/OR LAWSUITS BETWEEN YOU AND UBER, INCLUDING THE ARBITRATION AGREEMENT... REQUIRES YOU TO RESOLVE ALL DISPUTES WITH UBER ON AN INDIVIDUAL BASIS... THROUGH FINAL AND BINDING ARBITRATION.”

What that means: You lose the right to have your case heard by a jury of peers, potentially leading to different outcomes than public courts.

By accepting the terms, you explicitly waive the constitutional right to a trial by jury in favor of a private arbitrator's decision.

Medium cost

Unilateral changes with little or no notice

You are agreeing to let Uber change the contract terms unilaterally based on your continued usage.

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms through the Services or Uber’s website. ...your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: You may be bound by new unfavorable rules without explicit notification or a fresh chance to decline.

Uber can update the terms whenever they choose and declare that simply using the app afterward means you accept the new rules.

Medium cost

You take the risk of injury or death

You are agreeing to arbitrate claims involving personal injury or death.

“Your and our mutual agreement to arbitrate all disputes regardless of whether the dispute, claim, lawsuit, or controversy occurred or accrued before or after the date you agreed to these Terms, and regardless of whether you allege that the dispute, claim, or injury involves harm or injury to you or anyone else.”

What that means: You must pursue compensation for physical harm or death through private arbitration rather than public courts.

The arbitration clause covers personal injury and death claims, meaning you must arbitrate even if you are hurt or killed while using the service.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what Uber asks.
