What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Jury trial or court access waived

You are agreeing to give up your right to a jury trial in any legal dispute.

“BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”

What that means: You lose the right to have a judge or jury decide your case in a public court system.

The text explicitly states that users waive their constitutional right to a jury trial by accepting these terms.

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to a jury trial and bring claims only in individual arbitration.

“The Arbitration Agreement REQUIRES YOU TO RESOLVE ALL DISPUTES WITH UBER ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCEPTIONS, THROUGH FINAL AND BINDING ARBITRATION.”

What that means: You cannot join a class action lawsuit or participate in a group legal effort against Uber; all disputes must be handled individually.

The document mandates that all claims be settled in binding individual arbitration, explicitly prohibiting class actions, collective actions, or mass arbitrations.

High cost

Liability shifted onto the user

You are agreeing that Uber is not responsible for the safety or execution of the Third-Party Services provided by drivers or merchants.

“UBER IS NOT A COMMON CARRIER OR MOTOR CARRIER AND DOES NOT TRANSPORT PASSENGERS OR GOODS... THIRD-PARTY PROVIDERS ARE INDEPENDENT... ANY EFFORT... IS NOT AN INDICIA OF AN EMPLOYMENT... RELATIONSHIP WITH A THIRD-PARTY PROVIDER.”

What that means: If something goes wrong during a ride or delivery, you may find it difficult to hold Uber directly liable because they claim no direct involvement in the service provision.

The document disclaims that Uber is responsible for transporting you or goods, framing itself merely as a platform connecting you with independent third-party providers.

High cost

You take the risk of injury or death

You are agreeing to accept the risks associated with using autonomous vehicle technology, including potential failures.

“Autonomous Vehicles depend upon emerging technologies and could become inoperable... The AVs are not designed to provide transportation services in connection with emergencies... If you use AV Services, you acknowledge that you understand the risks described in this section.”

What that means: You accept the risk of getting stuck in a faulty robotaxi or being unable to access urgent care when using autonomous vehicles.

For autonomous vehicle rides, you explicitly acknowledge the risks of technology failure, including potential injury or inability to reach emergency destinations like hospitals.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that these terms apply to all aspects of the Uber ecosystem, including web platforms and mobile apps.

“These Terms consist of Uber’s Marketplace Platform... and any related content or services, including but not limited to... mobile and/or web-based applications... and together with the Uber Marketplace Platform, the 'Services'.”

What that means: Your agreement binds you across various interfaces and potential future service offerings under the Uber umbrella.

A single set of terms covers both the rider app and other potential services, creating a broad scope of agreement across different types of interactions.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by any future modifications to the Terms without additional notice or consent.

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time... Your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: You have no control over future changes to the agreement and must keep checking for updates to avoid violating unknown terms.

Uber can change the rules whenever it wants, and simply using the app after the update counts as your acceptance of the new terms.
