Risk score

87of 100

In short

  • You accept terms that require you to resolve all disputes with Uber through private arbitration instead of going to court.
  • You give up the right to participate in class actions or mass lawsuits against the company.
  • You also agree to a broad license for your user content and allow unlimited changes to these terms through continued use.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve any claims against Uber individually in binding arbitration, waiving your right to a jury trial or public court proceedings.

    Other products, stores, or brands

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration... You and Uber are each waiving your right to a jury trial.”
  2. 02

You are agreeing to let Uber modify these terms at any time, where your continued use of the services after posting updates counts as your agreement to those changes.

    This product

“Uber reserves the right to modify these Terms... at any time... your continued use of the Services after any such changes constitutes your agreement to such changes.”
  3. 03

You are agreeing to grant Uber a perpetual, worldwide, sublicensable license to use, reproduce, and distribute any user content you submit to the platform.

    This product

“[Included by reference via Supplemental Terms] User Generated Content Terms; ... [User grants] a perpetual, irrevocable, non-exclusive, fully-paid, royalty-free, worldwide license...”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to bring or join a class action lawsuit and resolve all disputes through individual binding arbitration.

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration as set forth in this Arbitration Agreement, and not as a class, collective, coordinated, consolidated, mass and/or representative action.”

What that means: You lose the ability to band together with other users to fight Uber in court, significantly increasing the cost and difficulty of seeking justice for widespread issues.

The document mandates that all disputes be settled through private binding arbitration on an individual basis, effectively barring users from joining class action lawsuits or mass arbitrations.

High cost

Jury trial or court access waived

You are agreeing to give up your right to a jury trial and to have your claims heard in a public court of law.

“IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”

What that means: Your dispute will be decided by a private arbitrator chosen by the companies, not by a jury of your peers in a transparent courtroom.

The terms explicitly state that you are waiving your constitutional right to have a judge or jury hear your case in a public court system.

High cost

Broad license to user content

You are agreeing to give Uber a permanent, free license to use any content you upload to their platform.

“Incorporated by reference: User Generated Content Terms... [User grants] a perpetual, irrevocable, non-exclusive, fully-paid, royalty-free, worldwide license...”

What that means: Uber can keep using your personal creative content forever, for any purpose, without paying you or asking for permission again.

By referencing the User Generated Content Terms within the main agreement, Uber secures permanent rights to use your photos, text, and videos even after you stop using the service.

High cost

Terms follow you to parks, stores, and other products

You are agreeing to a single set of rules that applies across all different types of transportation and delivery services offered by Uber.

“These Terms of Service... govern your use of Uber’s digital marketplace platform... and any related content or services, including but not limited to, mobile and/or web-based applications...”

What that means: One agreement controls your behavior and rights whether you are riding in a car, ordering food, or shipping packages.

The terms cover the entire ecosystem of Uber's marketplace platform, including ride-hailing, freight, delivery, and third-party provider interactions, binding you across these different service types.

Medium cost

Unilateral changes with little or no notice

You are agreeing to accept any future changes to the terms automatically just by continuing to use the service.

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting... your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: You might unknowingly agree to worse conditions because you did not check for updates before using the app again.

Uber can change the rules whenever they want, and simply keeping your account active is treated as if you signed off on the new version.

Medium cost

You take the risk of injury or death

You are agreeing to accept the risks of equipment failure and lack of emergency support when using autonomous vehicle services.

“If you use AV Services, you acknowledge that you understand the risks described in this section... The AVs are not designed to provide transportation services in connection with emergencies... you and your guests may not always be delivered to your intended destination(s).”

What that means: You accept that self-driving cars might break down or fail to get you to urgent places like hospitals, without Uber guaranteeing a solution.

When using autonomous vehicles, you acknowledge specific risks like vehicle inoperability or failure to reach destinations, accepting these as part of the service usage.

Medium cost

Liability shifted onto the user

You are agreeing that Uber is not liable for the actions of independent drivers or for the loss of access to your account due to fraud or inactivity.

“UBER IS NOT A COMMON CARRIER... THIRD-PARTY PROVIDERS ARE INDEPENDENT... ANY EFFORT... IS NOT AN INDICIA OF AN EMPLOYMENT... UBER ASSUME NO LIABILITY FOR SUCH LOSS OF ACCESS...”

What that means: You have limited recourse against Uber if a driver behaves poorly or if your account is deleted, as Uber denies being your employer or carrier.

Uber positions itself merely as a marketplace connecting you to independent providers, disclaiming liability for many issues including service access loss and provider actions.

Lower cost

Children’s data

You are agreeing to take responsibility for your child's account and compliance with terms if you enable Teen Account features.

“However, we may offer parents and guardians the ability to create Accounts for their children... If you are a parent or legal guardian, and you allow your child to use the Services... these Terms apply to you.”

What that means: Parents can link their accounts to their children, making the parent legally responsible for the child's activity and agreements.

While minors generally cannot create accounts, the terms explicitly outline a process for parents to manage accounts for children under 18.

If these terms already apply to you
