Risk score

46of 100

In short

  • You are agreeing to a binding contract with Uber that requires you to resolve disputes through individual arbitration, waiving your right to a jury trial or class action.
  • You also permit Uber to change the terms at any time, with your continued use of the service serving as your acceptance of those changes.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve all disputes with Uber through binding individual arbitration rather than in public court.

    This product

“You agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration as set forth in this Arbitration Agreement, and not as a class, collective, coordinated, consolidated, mass and/or representative action.”
  2. 02

You are agreeing that Uber can change these Terms at any time without meaningful notice, and your continued use constitutes agreement to the new terms.

    This product

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms... your continued use of the Services after any such changes constitutes your agreement to such changes.”
  3. 03

You are agreeing to accept communications from Uber and third parties via various methods, including automated calls and texts, which may incur message rates.

    Other companies

“By creating an Account, you electronically agree to accept and receive communications from Uber, Third-Party Providers or third parties providing services to Uber including via email, text message, WhatsApp, calls, in-app communications, and push notifications...”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to a jury trial and class action participation.

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration as set forth in this Arbitration Agreement, and not as a class, collective, coordinated, consolidated, mass and/or representative action.”

What that means: You lose the ability to sue in court or join a group lawsuit, making it harder and more expensive to enforce your rights against the company.

The document mandates that all disputes be settled in private arbitration. This prevents users from joining together in a class-action lawsuit to challenge Uber's practices or seek collective relief.

High cost

Jury trial or court access waived

You are agreeing to give up your right to a public jury trial.

“IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”

What that means: Your legal disputes are decided by a private arbitrator chosen by the industry, rather than by a neutral judge and jury of your peers.

The terms explicitly state that by accepting the agreement, you give up the constitutional right to have a judge and jury decide your case in a public courtroom.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future changes to the terms just by continuing to use the service.

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms through the Services or Uber’s website. You should regularly review these Terms, as your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: You may be bound by new, unfavorable rules without receiving direct notification or having the chance to explicitly consent to them.

Uber can update the rules whenever they want, and simply posting the new terms is enough to bind you if you keep using the app.

Medium cost

You take the risk of injury or death

You are agreeing to accept the risks associated with the potential failure or erratic operation of autonomous vehicles.

“Autonomous Vehicles depend upon emerging technologies and could become inoperable or inaccessible for a period of time or may function erratically or improperly with little to no advance notice... If you use AV Services, you acknowledge that you understand the risks described in this section.”

What that means: If an autonomous vehicle malfunctions or fails to deliver you safely, you have acknowledged these risks in advance.

When using autonomous vehicle features, you acknowledge that the technology may fail or cause disruptions, and you accept these operational risks.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what Uber asks.
