Risk score

99of 100

In short

  • You are accepting terms that allow Uber to change rules at any time without specific notice.
  • You agree to resolve all disputes through private arbitration, giving up your right to a jury trial or class action lawsuit.
  • The document also binds you to the terms of third-party service providers and related platforms.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to binding arbitration for all disputes instead of going to court.

    This product

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration... and not as a class... action.”
  2. 02

You are agreeing that Uber can modify the Terms at any time with continued use constituting acceptance.

    Other products, stores, or brands

“Uber reserves the right to modify these Terms... at any time... your continued use of the Services after any such changes constitutes your agreement to such changes.”
  3. 03

You are agreeing to be bound by additional policies like the Privacy Notice, User Generated Content Terms, and Community Guidelines.

    Other products, stores, or brands

“These include but are not limited to: the Privacy Notice; User Generated Content Terms; Community Guidelines... collectively, the “Supplemental Terms.””

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to a jury trial and participate only in individual arbitration.

“You are each waiving your right to a jury trial. This Arbitration Agreement will preclude you from bringing any class... action against Uber...”

What that means: You cannot sue Uber in public court or join other users in a group lawsuit if something goes wrong.

The contract forces users into private arbitration for all disputes, including personal injury claims, and explicitly bans them from joining or initiating class action lawsuits.

High cost

Jury trial or court access waived

You are agreeing to give up your right to seek relief in a court of law or have a jury trial.

“IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”

What that means: A panel of arbitrators chosen by private firms decides your case, not a judge or jury.

The document highlights in all caps that signing means you give up your constitutional right to a jury trial.

High cost

You take the risk of injury or death

You are agreeing to arbitrate disputes involving personal injury, death, or accidents connected to the services.

“This Arbitration Agreement survives after your relationship with Uber ends... disputes arising out of or relating to... incidents or accidents resulting in personal injury or death to you or anyone else...”

What that means: You assume the risk of injury or death and cannot bring those claims in a traditional lawsuit.

Users must arbitrate claims involving personal injury or death, even if the incident occurred before agreeing to the terms or involves harm to third parties.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that other agreements regarding Third-Party Services (like driving or delivering) take precedence over these Terms if they conflict.

“Notwithstanding the foregoing, if you choose... to provide transportation... logistics... delivery... these Terms of Service do not supersede... any agreements you may have with Uber... regarding such Third-Party Services (e.g., the Platform Access Agreement, the Technology Services Agreement)...”

What that means: Your rights and obligations change significantly depending on whether you are riding, delivering, or driving.

Accepting these general terms does not override separate agreements for drivers, freelancers, or logistics partners, creating a fragmented legal landscape where different terms apply based on role.

High cost

Car or smart-home data always on

You are agreeing to audio, video, and sensor recording by autonomous vehicles during rides.

“When you use AV Services, audio, video, and other sensor recordings may be generated by the AV’s systems for safety, security, or service quality purposes. By using the AV Services, you consent to such recordings.”

What that means: Your conversations, movements, and surroundings inside the vehicle are recorded and stored.

Autonomous vehicles collect audio, video, and sensor data continuously while in operation, which remains property of Uber/partners.

Medium cost

Unilateral changes with little or no notice

You are agreeing to accept unilateral modifications to the Terms based solely on your continued use of the Services.

“Uber reserves the right to modify these Terms... effective upon posting... your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: The rules governing your account can change without direct notification or renewed explicit consent.

Uber can change the rules at any time, and simply continuing to use the app counts as consent to the new terms.

Medium cost

Children’s data

You are agreeing to allow your child under 18 to use the Services under a Teen Account managed by you.

“However, we may offer parents and guardians the ability to create Accounts for their children... If you are a parent or legal guardian, and you allow your child to use the Services... these Terms apply to you...”

What that means: Minors can access the service, subjecting their data to the platform's terms and monitoring.

The document allows children under 18 to use the service via teen accounts created by parents/guardians, implying data collection from minors.

Medium cost

Liability shifted onto the user

You are agreeing that Uber is not liable for Third-Party Services, out-of-app experiences, or accidents involving independent providers.

“UBER IS NOT A COMMON CARRIER OR MOTOR CARRIER AND DOES NOT TRANSPORT PASSENGERS OR GOODS... THIRD-PARTY PROVIDERS ARE INDEPENDENT... UBER WILL NOT WARN YOU THAT YOU HAVE LEFT THE SERVICES... Uber does not endorse such Out-of-App Experience providers and in no event shall Uber be responsible or liable for any products or services of such providers.”

What that means: You hold the risk for injuries, damages, or issues arising from third-party providers or linked external sites.

Uber disclaims liability for third-party services, accidents, and out-of-app experiences, shifting risk entirely to the user and independent providers.

If these terms already apply to you
