In short

  • You are agreeing to a legally binding contract with Uber that governs your use of the app and marketplace services.
  • By accepting these terms, you waive your right to sue in public court or join other users in group lawsuits for any disputes.
  • Uber can also change these rules at any time, and your continued use of the app means you accept those changes.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve all disputes through private arbitration instead of going to court.

    This product

“By agreeing to these Terms, you agree that you are required to resolve any claim and/or lawsuit that you may have against Uber on an individual basis in binding arbitration as set forth in this Arbitration Agreement, and not as a class, collective, coordinated, consolidated, mass and/or representative action.”
  2. 02

You are agreeing that you will not participate in any class action or mass action against Uber.

    This product

“This Arbitration Agreement will preclude you from bringing any class, collective, coordinated, consolidated, mass, and/or representative action against Uber...”
  3. 03

You are agreeing to let Uber change these terms whenever they want, with no further notice required.

    This product

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version... Your continued use of the Services after any such changes constitutes your agreement to such changes.”
  4. 04

You are agreeing that Uber can terminate your account or access to services at any time for any reason.

    This product

“Uber, in its sole discretion, may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to give up your right to a public court trial and to be part of a group legal action.

What that means: You cannot join a class action lawsuit, meaning you must pay to fight Uber alone if you have a grievance.

The document forces all disputes into private binding arbitration, explicitly banning class actions, collective actions, or mass actions. This prevents users from banding together to challenge the company.

High cost

Jury trial or court access waived

You are agreeing to waive your right to a jury trial in any dispute with Uber.

“IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.”

What that means: A private arbitrator decides your case, not a jury of peers, which often favors corporations.

The user explicitly waives the constitutional right to a jury trial. All claims are handled by arbitrators chosen privately.

High cost

You take the risk of injury or death

You are agreeing to arbitrate claims involving personal injury or death under these terms.

“You and Uber mutually agree to arbitrate any disputes arising out of or relating to... incidents or accidents resulting in personal injury or death to you or anyone else that you allege occurred in connection with your use of the Services... regardless of whether the claim, injury, or lawsuit allegedly occurred or accrued before or after the date you agreed to these Terms...”

What that means: If you are injured or killed using the service, you must seek resolution through private arbitration, potentially limiting your compensation.

The arbitration clause covers personal injury and death claims. Combined with other liability waivers (Section 8), this shifts significant risk onto the user regarding physical safety.

High cost

Liability shifted onto the user

You are agreeing that Uber is not responsible for the transport provided by third-party drivers.

“UBER IS NOT A COMMON CARRIER OR MOTOR CARRIER AND DOES NOT TRANSPORT PASSENGERS OR GOODS... THIRD-PARTY PROVIDERS ARE INDEPENDENT AND NOT ACTUAL AGENTS, APPARENT AGENTS, OSTENSIBLE AGENTS, OR EMPLOYEES OF UBER IN ANY WAY.”

What that means: Uber may avoid financial responsibility for injuries or damages caused by the driver or vehicle.

Uber disclaims responsibility for the actual transportation, labeling providers as independent third parties. This limits Uber's liability for accidents or issues during the ride itself.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future changes to these terms made solely by Uber.

“Uber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms through the Services or Uber’s website. You should regularly review these Terms, as your continued use of the Services after any such changes constitutes your agreement to such changes.”

What that means: You may unknowingly agree to new unfavorable terms just by continuing to use the app.

Uber can update the terms unilaterally without notifying you individually. Continued use is treated as acceptance.

Medium cost

Car or smart-home data always on

You are agreeing to allow audio and video recording by autonomous vehicles during rides.

“When you use AV Services, audio, video, and other sensor recordings may be generated by the AV’s systems for safety, security, or service quality purposes. By using the AV Services, you consent to such recordings.”

What that means: Your conversations and surroundings inside the autonomous vehicle are being recorded.

Autonomous vehicles record audio and video continuously. Users consent to this surveillance when using the AV service.

Medium cost

Children’s data

You are agreeing to allow minors to use the service under parental supervision.

“You may not allow persons under the age of 18 to use the Services unless they are accompanied by you or an adult. However, we may offer parents and guardians the ability to create Accounts for their children.”

What that means: Parents can grant children access, subjecting them to different contractual terms and monitoring.

The service allows children (teens) to have accounts under specific conditions, requiring parental oversight and separate teen terms.

Lower cost

Difficult or incomplete deletion

You are agreeing to provide access to your wireless carrier data for identification.

“Additionally, you authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to Uber or its service providers for the duration of your business relationship, solely to help Uber identify you or your wireless device and to prevent fraud.”

What that means: Deleting your account might not instantly remove data tied to your mobile carrier for identity verification purposes.

While the text allows disabling accounts, it highlights reliance on telecom data which may persist. The full deletion policy details are linked but the active text implies ongoing verification needs.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what Uber asks.
