Risk score

In short

  • These terms grant Meta a broad license to use your content and allow them to show you personalized ads based on your data.
  • They limit how you can sue Meta if problems arise, restricting court access to specific locations.
  • The agreement also allows the company to change terms without requiring new explicit consent from you.

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to grant a broad, sublicensable license to all content you upload.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content”

What that means: Meta can reuse, sell rights to, or modify your photos and videos in ways that go beyond simple hosting.

The document grants a wide-ranging license allowing Meta to sublicense, modify, and create derivative works from user content globally.

High cost

Tracking you across apps

You are agreeing to the use of your on and off-platform data for personalization.

“we use data about the connections you make, the choices and settings you select, and what you share and do on and off our Products - to personalize your experience.”

What that means: Your activity across other websites and apps may be tracked and used to target ads to you.

Meta collects data from activities both on and off their products to build a profile for personalized advertising and experiences.

High cost

Liability shifted onto the user

You are agreeing that Meta is not liable for the actions or content of other users.

“We do not control or direct what people and others do or say... and we are not responsible for their actions or conduct... including offensive, inappropriate, obscene, unlawful, and other objectionable content.”

What that means: If harmed by illegal or offensive content posted by others, you have limited recourse against Meta.

The terms explicitly disclaim responsibility for user-generated content and third-party actions on the platform.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future term updates through continued usage.

“Unless otherwise required by law, we will notify you before we make changes to these Terms... Once any updated Terms are in effect, you will be bound by them if you continue to access or use our Products.”

What that means: You are bound by new terms simply by continuing to use the app, even if you did not actively sign again.

The company can update the terms at any time. Continued use of the service after notification acts as acceptance of the new rules.

Medium cost

Difficult or incomplete deletion

You are agreeing to a delayed deletion process that includes retention in backup systems.

“After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data is not immediately and fully erased; traces may persist in backups for weeks.

Even after account deletion is initiated, residual copies of data may remain in backup systems for extended periods.

Medium cost

Jury trial or court access waived

You are agreeing to submit to the exclusive jurisdiction of California courts.

“any claim, cause of action, or dispute between us that arises out of or relates to these Terms... shall be resolved exclusively in the U.S. District Court for the Northern District of California or a state court located in San Mateo County.”

What that means: Legal battles require traveling to or hiring counsel in California, increasing the cost and difficulty of justice.

Disputes must be heard in specific California courts, preventing the user from suing in their local jurisdiction.
