What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to let Meta own a broad license to copy, modify, and share your content anywhere, even after you delete it from your main view.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on Facebook, you give us permission to store, copy, and share it with others...”

What that means: Meta can reuse, modify, or share your photos and posts widely, potentially with third parties or partners, without needing further permission from you.

The document grants Meta a very broad license to user-generated content that is transferable and sublicensable, exceeding what is strictly necessary just to display the content to friends.

High cost

Difficult or incomplete deletion

You are agreeing to a process where full data erasure takes up to 180 days and depends on technical feasibility.

“After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data remains stored and accessible within the company's internal backup systems for months after you believe it has been deleted.

Even after account deletion is initiated, content persists in backup systems for up to 180 days total before being fully removed.

High cost

Indefinite retention

You are agreeing that your data may be kept indefinitely if it was shared by others or if Meta claims it is needed for investigation or legal compliance.

“Content will not be deleted within 90 days... where your content has been used by others in accordance with this license and they have not deleted it (in which case this license will continue to apply until that content is deleted); where immediate deletion would restrict our ability to: investigate or identify illegal activity... protect the safety... comply with legal obligations...”

What that means: Your data might never be fully deleted if it has been shared by others or if Meta decides it is needed for vague security or legal reasons.

Retentions exceptions are extremely broad, allowing indefinite retention if others use the content or if Meta claims a need for safety or legal compliance.

High cost

Liability shifted onto the user

You are agreeing to waive most rights to sue for damages and accept that Meta’s maximum liability is limited to $100.

“Our Products, however, are provided "as is," and we make no guarantees that they always will be safe, secure, or error-free... under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages... Our aggregate liability... will not exceed the greater of $100 or the amount you have paid us in the past twelve months.”

What that means: If the service fails or leaks your data, you cannot sue for significant damages, as the maximum payout is capped at $100.

The service is provided 'as is' with no warranty, and Meta limits its financial liability to $100, shifting all risk of service failure or data loss to the user.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that using any related feature or service may automatically bind you to additional, separate legal documents.

“For example, if you access or use our Products for commercial or business purposes... you must agree to our Commercial Terms. If you post or share content containing music, you must comply with our Music Guidelines. If you use Avatars, then the Avatar Terms also apply. If you use our AI products and features, the Meta AI Terms also apply.”

What that means: Interacting with minor features like Avatars, AI, or business tools subjects you to entirely different sets of rules and restrictions beyond the main ToS.

Using specific features or products within the ecosystem triggers additional, separate terms that become part of the agreement, potentially adding more restrictions.

Medium cost

Tracking you across apps

You are agreeing to let Meta track your activity on and off their services to tailor the content and ads you see.

“We use data about the connections you make, the choices and settings you select, and what you share and do on and off our Products - to personalize your experience.”

What that means: Your activity on other websites and apps may be collected and used to determine the ads you see on Facebook.

Meta tracks user activity both on and off their platform to build profiles for ad targeting and personalization.

Medium cost

Unilateral changes with little or no notice

You are agreeing that continued use of the product binds you to any updated terms, even if you did not explicitly click 'agree' to the new version.

“Unless otherwise required by law, we will notify you before we make changes to these Terms... Once any updated Terms are in effect, you will be bound by them if you continue to access or use our Products.”

What that means: If you keep using the app after they update the rules, you automatically accept the new terms without needing to actively agree again.

Meta can change the terms and you remain bound by them simply by continuing to use the service, although they claim to provide notice.
