In short

  • You are agreeing to a contract that governs your access to X services and requires you to follow strict usage rules.
  • The document places the risk of using the service on you and limits what you can sue for if things go wrong.
  • You also grant the company broad rights to use your posted content for any purpose, including training AI.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to let X and its partners display advertising to you while using the Services.

    This product

“X and our third-party providers and partners may display advertising to you.”
  2. 02

You are agreeing to give X a worldwide, perpetual license to use, modify, and share your content with others without paying you.

    Other products, stores, or brands

“you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, upload, download, and distribute such Content”
  3. 03

You are agreeing to resolve disputes in Texas courts or arbitration and giving up your right to a jury trial or class action.

    This product

“any disputes between you and us will be resolved by a court in Texas... you agree to waive any right to bring a class action or other representative action.”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to have disputes resolved by binding arbitration instead of a court trial.

“unless the forum selection clause in these Terms is unenforceable for any reason, then the dispute will be arbitrated.”

What that means: You lose the ability to have a judge or jury hear your case in public court.

If court jurisdiction fails, the default path for resolving disputes is binding arbitration. This restricts where and how you can legally challenge the company.

High cost

Jury trial or court access waived

You are agreeing to waive your right to a trial by jury.

“BY ENTERING INTO THESE TERMS, YOU AND X ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO BRING... ANY PURPORTED CLASS ACTION... OF ANY KIND”

What that means: You cannot demand a jury of your peers to decide your lawsuit.

The contract explicitly states that you waive your constitutional right to a jury trial for any claims against X or its affiliates.

High cost

Liability shifted onto the user

You are agreeing to accept liability limits that cap the company's damages to you at $100 or recent payments.

“THE X ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS... IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE X ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID US”

What that means: You bear the risk of service failures or data loss, and cannot recover large damages from the company.

The service is provided 'as-is' with no warranties. Even if X causes you significant harm, their financial responsibility is capped at $100 or what you paid them recently.

High cost

Broad license to user content

You are agreeing to grant a broad, sublicensable license for your content that covers AI training and third-party distribution.

“you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense)... for any purpose... for use with and training of our machine learning and artificial intelligence models”

What that means: Your posts, images, and videos can be used commercially and for AI training without your control or compensation.

You give the company permission to use your content in any media, transfer it to partners, and use it to train AI systems. They do not have to pay you for this.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that the same restrictive legal venue and arbitration terms apply to your affiliates like SpaceX and Cursor.

“The choice, law, jurisdiction, and arbitration provisions of this section shall also extend to disputes involving our U.S. corporate affiliates, including but not limited to any U.S. SpaceXAI, Cursor, or SpaceX entities”

What that means: Disputes with sister brands or subsidiaries must also go through Texas arbitration, limiting your legal options across the corporate family.

The restrictive legal clauses (Texas courts/arbitration/jury waiver) apply not just to X, but also to affiliated companies like SpaceX and Cursor. Accepting one binds you to the others' dispute resolution terms.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future revisions of the terms simply by continuing to use the service.

“We may revise these Terms from time to time... By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.”

What that means: You might be bound by new rules you haven't fully reviewed if you continue to use the app.

The company can change the terms whenever they want. Your only choice is to keep using the service (accepting new terms) or stop using it entirely.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what X asks.
