What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to let Meta and its partners use, modify, and share your content widely.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content”

What that means: You give up control over how your photos and posts are used and shared by Meta or its partners.

Meta takes a broad license to your content that allows them to sub-license it to others and modify it, extending beyond simple service delivery.

High cost

Liability shifted onto the user

You are agreeing to accept a strict cap on Meta's liability for any issues with their services.

“our liability shall be limited to the fullest extent permitted by applicable law... Our aggregate liability arising out of or relating to these Terms or the Meta Products will not exceed the greater of $100 or the amount you have paid us in the past twelve months.”

What that means: You cannot sue for significant damages even if the service causes you loss or harm.

The terms limit Meta's financial responsibility for damages to a very small cap, shifting most risk to you.

High cost

Tracking you across apps

You are agreeing to have your activity and interests monitored to target ads to you.

“We use your personal data to help determine which personalized ads to show you. We use your personal data, such as information about your activity and interests, to show you personalized ads and sponsored content that may be more relevant to you.”

What that means: Your online behavior is tracked and used to build a profile for advertising purposes.

Your activity and interests across the platform are analyzed to target advertisements specifically to you.

High cost

Terms follow you to parks, stores, and other products

You are agreeing to terms that cover multiple products like Facebook, Messenger, and other Meta services.

“If you do not agree to these Terms, then do not access or use Facebook or the other products and services covered by these Terms. ... Your use of Instagram is subject to the Instagram Terms of Use.”

What that means: Accepting these terms binds you to a large suite of Meta services rather than just one app.

While Instagram has separate terms, this document covers a wide range of 'Meta Products' including Messenger and potentially other services listed under Meta Company Products, creating a broad ecosystem agreement.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future updates to the terms just by keeping your account active.

“Once any updated Terms are in effect, you will be bound by them if you continue to access or use our Products.”

What that means: You may lose rights or gain obligations without explicitly clicking 'Agree' again to each change.

Meta can change the terms at any time, and your continued use of the app serves as consent to the new rules.

Medium cost

Difficult or incomplete deletion

You are agreeing to a delay in the complete erasure of your data from backup systems.

“After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Deleted content may still exist in backups for up to 90 days after removal.

Content remains in backup systems for a long period after you request deletion, making true erasure difficult immediately.

Medium cost

Indefinite retention

You are agreeing to potential indefinite retention of your content for security or legal investigations.

“Content will not be deleted within 90 days... where immediate deletion would restrict our ability to... investigate or identify illegal activity or violations of our terms and policies”

What that means: Your data may be retained longer than requested if Meta claims a need for investigation.

Meta keeps your content indefinitely if they believe it is needed for investigations or security, overriding deletion requests.

Lower cost

Children’s data

You are agreeing that only users 13 or older may use the service.

“You cannot use Facebook if: You are under 13 years old.”

What that means: Children under 13 are prohibited from using the service.

The document explicitly bars users under 13, indicating they do not collect data from children under this age group legally.
