In short

  • You are agreeing to use Spotify’s music and content services under strict conditions.
  • You waive your right to a jury trial or class action, forcing disputes into individual arbitration.
  • Spotify can change prices or service features without your explicit consent and holds broad rights to your data and content.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve all disputes through binding individual arbitration, waiving your right to a jury trial or class action.

    This product

“THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT... REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR ANY OTHER COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND.”
  2. 02

You are agreeing to grant Spotify a perpetual, worldwide license to use your user content, including the ability to sublicense it.

    This product

“you hereby grant to Spotify a non-exclusive, transferable, sublicensable, royalty-free, fully paid, irrevocable, worldwide license to reproduce, make available, perform and display, translate, modify, create derivative works from, distribute, and otherwise use any such User Content”
  3. 03

You are agreeing to indemnify Spotify for any damages, losses, or legal costs arising from your breach of these terms or use of the service.

    This product

“You agree to indemnify and hold Spotify harmless from and against all damages, losses, and expenses of any kind (including reasonable attorneys' fees and costs) arising out of or related to: (1) your breach of any of these Terms... (4) your violation of any law or the rights of a third party.”

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to settle any legal disputes through mandatory individual arbitration instead of a courtroom trial.

“THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT... REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR ANY OTHER COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND. IN ARBITRATION THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT.”

What that means: You lose the right to sue in public court or join a class action lawsuit if you have a dispute with Spotify.

The document forces users into binding individual arbitration, explicitly stating that there is less discovery and appellate review than in court proceedings.

High cost

Jury trial or court access waived

You are agreeing to give up your right to have a jury hear your case if a dispute arises.

“To the fullest extent permitted by applicable law, the parties agree to waive any right to a jury trial.”

What that means: If your case goes to arbitration or a limited court proceeding, a judge will decide the outcome, not a jury of peers.

Users explicitly waive their constitutional right to a jury trial as part of the governing law and jurisdiction section.

High cost

Broad license to user content

You are agreeing to let Spotify permanently share and reuse your posted content with others.

“You retain ownership of your User Content when you post it to the Spotify Service. However... you hereby grant to Spotify a non-exclusive, transferable, sublicensable, royalty-free, fully paid, irrevocable, worldwide license to... User Content”

What that means: Spotify can share your playlists, comments, or uploads with other companies and use them in new ways without asking you again.

While you retain ownership, you grant Spotify a broad, perpetual, and sublicensable license to use, modify, and distribute your content anywhere.

High cost

Liability shifted onto the user

You are agreeing that your only option for dissatisfaction is to stop using the service, not to seek damages.

“YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE SPOTIFY SERVICE IS TO UNINSTALL ANY SPOTIFY SOFTWARE AND TO STOP USING THE SPOTIFY SERVICE.”

What that means: If you are unhappy with the service quality or errors, you cannot seek financial compensation or other legal redress.

The document limits your legal remedy for dissatisfaction to simply uninstalling the app, waiving other claims.

High cost

Auto-renewal or hard-to-cancel paid terms

You are agreeing to automatic recurring payments that continue indefinitely until you actively cancel.

“Paid Subscriptions continue indefinitely until cancelled. You will be billed on a recurring basis on the first day of each billing period and you will pay and you authorise us (or the applicable third party, if you sign up through a third party) to charge your payment method the then-current subscription fee.”

What that means: You will be charged monthly or yearly forever until you remember to log in and manually cancel.

Subscriptions auto-renew indefinitely, and users authorize automatic charges to their payment method upon renewal.

Medium cost

Unilateral changes with little or no notice

You are agreeing that Spotify can change or stop parts of the service without telling you in advance.

“Spotify reserves the right to change our Spotify Service offerings and their availability from time to time, without notice or liability to you.”

What that means: Features you rely on may disappear or be altered without warning, and you cannot sue for those specific changes.

The company can modify or stop services and features at its discretion without providing prior notice or accepting liability for the changes.

Medium cost

Unilateral changes with little or no notice

You are agreeing that using the service after a price hike means you accept the higher cost.

“Price changes will take effect at the start of the next subscription period following the date of the price change and, by continuing to use the Spotify Service after the price change takes effect, you will have accepted the new price.”

What that means: Your subscription cost may increase automatically unless you actively cancel before the new rate applies.

Spotify can raise prices for subscriptions and consider your continued usage as acceptance of the new rate.

Medium cost

Liability shifted onto the user

You are agreeing to limit how much money Spotify can be forced to pay you if things go wrong.

“TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SPOTIFY... BE LIABLE FOR... INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES... OR ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS...”

What that means: Even if Spotify's negligence causes significant data loss or business harm, your maximum financial recovery is very limited.

Spotify caps its total liability at $30 or amounts paid in the last 12 months and excludes consequential damages like lost profits or data.

Medium cost

Children’s data

You are agreeing that the service may be used by minors with parental oversight or consent.

“BY USING THE SPOTIFY SERVICE, YOU AFFIRM THAT YOU ARE 18 YEARS OR OLDER TO ENTER INTO THESE TERMS, OR, IF YOU ARE NOT, THAT YOU ARE 13 YEARS OR OLDER AND HAVE OBTAINED PARENTAL OR GUARDIAN CONSENT... In certain markets, Spotify may offer primary account holders the opportunity to allow access to a kids experience as part of a family subscription.”

What that means: Children may use the service and have their data collected under these terms if a parent sets it up.

The terms permit use by children aged 13-17 with parental consent and mention a specific 'kids experience' for younger users under family plans.

Lower cost

Terms follow you to parks, stores, and other products

You are agreeing that using Spotify with other apps or devices may involve extra rules from those third parties.

“The Spotify Service may be integrated with, or may otherwise interact with, third-party applications, websites, and services ('Third-Party Applications') and third-party personal computers, mobile handsets, tablets, wearable devices, speakers, and other devices ('Devices').”

What that means: Using Spotify with external devices may expose you to different rules set by Apple, Android, or speaker manufacturers.

The terms acknowledge integration with various third-party hardware and software, subjecting users to additional third-party policies.
