What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to let X and its partners use, modify, and share your content without pay.

“you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, upload, download, and distribute such Content... for any purpose”

What that means: You lose control over how your posts are used, shared, or modified by the platform and its partners.

The terms give X a perpetual, worldwide, and sublicensable license to your content. They can let others use it, modify it, or sell access to it without paying you. The only compensation is

High cost

Forced arbitration or class-action waiver

You are agreeing to resolve disputes individually in Texas courts or via private arbitration, giving up your right to a jury trial.

“all disputes related to these Terms... shall be brought and must proceed exclusively in the federal or state courts located in Wichita County or Tarrant County, Texas... If... unenforceable... binding arbitration... conducted on an individual basis only”

What that means: You face higher costs and less privacy if you need to legally challenge X, and you cannot join other users in suing them.

You cannot sue in public court if you are outside the EU/UK. Disputes must go to Texas courts or private arbitration. This prevents joining a class action lawsuit.

High cost

Jury trial or court access waived

You are agreeing to waive your right to a trial by jury in any legal proceeding against X.

“WHERE PERMITTED BY APPLICABLE LAW, BY ENTERING INTO THESE TERMS, YOU AND X ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO BRING, JOIN, OR PARTICIPATE IN ANY PURPORTED CLASS ACTION”

What that means: If you have a legal dispute, a single judge or arbitrator decides the outcome, not a group of peers.

The document explicitly states that you waive the right to a jury trial. This applies to all users regardless of whether they are natural persons or entities.

High cost

Liability shifted onto the user

You are agreeing that X is not liable for most damages, with their total responsibility capped at $100.

“THE X ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS... THE X ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES... IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE X ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS”

What that means: If X's service fails or causes you significant loss, you likely cannot recover damages beyond a very small amount.

X disclaims all warranties and limits its total financial liability to $100 or what you paid them in six months, whichever is greater. They are not responsible for data loss, service interruptions, or harm from other users' content.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that the same restrictive legal clauses apply to X's affiliates, including SpaceX and Cursor.

“The choice, law, jurisdiction, and arbitration provisions of this section shall also extend to disputes involving our U.S. corporate affiliates, including but limited to any U.S. SpaceXAI, Cursor, or SpaceX entities”

What that means: Disputes with these sister companies are also resolved privately in Texas, stripping your usual legal protections across multiple brands.

The terms bind you to arbitration and Texas jurisdiction not just for X, but also for affiliated companies like SpaceX, Cursor, and SpaceXAI. These entities are intended third-party beneficiaries.

Medium cost

Children’s data

You are agreeing that you meet the minimum age requirement of 13 to use the service.

“In any case, you must be at least 13 years old to use the Services.”

What that means: Users under 13 are barred, but teenagers can create accounts without parental oversight.

The terms set the minimum age at 13, which aligns with COPPA but allows collection of data from children aged 13-18 without parental consent.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by any future changes to the terms whenever you continue using the service.

“We may revise these Terms from time to time. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.”

What that means: You may be bound by new rules without explicit renewed consent, simply by keeping your account active.

X can change the terms at any time. Continued use of the service counts as acceptance of the new terms. While they promise to notify you, the enforcement relies on your continued usage.

Medium cost

Liability shifted onto the user

You are agreeing that X is not liable for the actions or content of other users on the service.

“YOU AGREE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THAT THE X ENTITIES ARE NOT RESPONSIBLE OR LIABLE TO YOU OR OTHERS FOR THE ACTIONS OR CONDUCT OF USERS AND THIRD PARTIES ON THE SERVICES”

What that means: You have limited recourse if you are harmed by other users' posts or interactions on the platform.

X takes no responsibility for offensive, defamatory, or illegal content posted by other users. You bear the risk of encountering harmful material.

Medium cost

You take the risk of injury or death

You are agreeing to use the service at your own risk, including exposure to potentially harmful content.

“Your access to and use of the Services or any Content are at your own risk... you may be exposed to offensive, harmful, inaccurate or otherwise inappropriate... Content”

What that means: You accept the possibility of seeing harmful content as a condition of using the app.

The terms explicitly state that using the service is at your own risk. You acknowledge that you might see harmful or inaccurate content and assume responsibility for that exposure.

Lower cost

Indefinite retention

You are agreeing that key contractual obligations and licenses survive your account deletion.

“the following sections shall continue to apply: 2, 3, 5, 6... For the avoidance of doubt, these Terms survive the deactivation or termination of your account.”

What that means: Your legal obligations and X's rights to your content continue even after you leave the platform.

Even if you delete your account, certain parts of the agreement (privacy, content license, liability) remain in effect. The document does not specify when data is deleted, only that the legal terms persist.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what X asks.
