What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to give Meta broad rights to use, share, and modify your content.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content”

What that means: You lose control over how your photos, videos, and text are used, shared, or modified by Meta and its partners.

The license is perpetual in duration until content is deleted, transferable, and sublicensable. This allows Meta to share your content widely, including with partners or other entities, without compensation.

High cost

Liability shifted onto the user

You are agreeing to waive most rights to sue for damages or losses.

“our liability shall be limited to the fullest extent permitted by applicable law. To the fullest extent permitted by law under no circumstance will we be liable to you for any lost profits, revenues, information, or data... or consequential, special, indirect... damages”

What that means: If something goes wrong, such as a data leak or service failure causing loss, you likely cannot recover significant damages.

Meta disclaims all warranties ('as is') and limits its financial liability to the maximum extent allowed by law, excluding many types of damages even if caused by negligence.

High cost

Tracking you across apps

You are agreeing to cross-site tracking and profiling for advertising purposes.

“we use data about the connections you make, the choices and settings you select, and what you share and do on and off our Products - to personalize your experience.”

What that means: Your behavior across the web and within apps is tracked to deliver targeted advertisements.

Meta collects data on your activity both on and off its products to build profiles for ad targeting.

High cost

Terms follow you to parks, stores, and other products

You are agreeing that your usage and content license extend to all affiliated Meta products like Instagram and Messenger.

“Your experience on Facebook is unlike anyone else's... to personalize your experience. We also enable you to communicate with a business you follow on Facebook through Messenger... consistent with your privacy and application settings... Meta Products or service providers”

What that means: Actions on one platform (like Facebook) affect your experience on others (like Instagram/Messenger), and content licenses apply across the ecosystem.

The Terms apply to 'Meta Products' including Instagram and Messenger. Data and licenses are shared across these properties. The document explicitly mentions sharing data with 'Meta Companies' for safety and interoperability.

Medium cost

Difficult or incomplete deletion

You are agreeing to wait up to 180 days total for full data erasure from backup systems.

“After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data remains accessible to Meta internally for months after you request deletion.

Data removal from backups and disaster recovery systems can take up to 90 days after initial deletion requests are processed.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by updated terms simply by continuing to use the service.

“We will notify you (for example, by email or through our Products) at least 30 days before we make changes to these Terms... Once any updated Terms are in effect, you will be bound by them if you continue to access or use our Products.”

What that means: You may be bound by new rules without explicitly agreeing to them again, as long as you keep using the app.

Meta can change the terms with 30 days' notice. Continued use constitutes acceptance. There is no requirement for explicit consent or re-clicking 'Agree'.

Lower cost

Children’s data

You are agreeing that you are at least 13 years old to use the service.

“You cannot use Facebook if: You are under 13 years old.”

What that means: Children under 13 are prohibited from using the service.

The Terms explicitly state that users must be at least 13 years old to create an account.
