In short

  • These Terms allow Meta to show you personalized ads using your data, grant them broad rights to use your content, and limit their liability if services fail.
  • You must bring disputes in specific US courts, waiving local court access for most claims.
  • Deletion takes up to 180 days to fully clear from backups, and changes bind you if you keep using the service.

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to a broad, transferable license allowing Meta and its partners to use your content forever until deleted by everyone.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content”

What that means: You lose control over how others use your content if Meta shares it with partners who do not delete it.

The terms take a very broad license to user content. It allows sublicensing and transfer, which means Meta can let other companies use your photos or videos even after you delete them, until those third parties delete them.

High cost

Difficult or incomplete deletion

You are agreeing to a delayed deletion process where data persists in backups for up to 180 days total.

“It may take up to 90 days to delete content... After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data remains on backup servers for months after you request deletion, increasing privacy risk.

Deletion is delayed. While visible deletion happens within 90 days, the full technical removal from backups takes another 90 days. This is a long retention period for deleted data.

High cost

Liability shifted onto the user

You are agreeing that Meta is not liable for damages beyond $100 and provides no guarantees for safety or performance.

“Our Products, however, are provided "as is," and we make no guarantees that they always will be safe, secure, or error-free... our aggregate liability... will not exceed the greater of $100 or the amount you have paid us in the past twelve months.”

What that means: You bear the risk of service errors, hacks, or data loss, and cannot sue for significant damages.

Meta provides the service 'as is' with no warranties for safety or security. Their financial liability for damages is capped at a very low amount ($100 or what you paid), leaving you with little recourse for service failures.

High cost

Jury trial or court access waived

You are agreeing to resolve disputes in specific US courts under California law.

“any claim... shall be resolved exclusively in the U.S. District Court for the Northern District of California or a state court located in San Mateo County.”

What that means: You may have to travel to or litigate in US courts rather than using your local justice system.

This clause forces legal disputes into specific US courts in California. For users outside these jurisdictions, this limits access to local public courts and implies a waiver of jury trials in many contexts, though it does not explicitly say 'no jury', it restricts forum significantly.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future changes to the terms just by continuing to use the product.

“Unless otherwise required by law, we will notify you before we make changes to these Terms... Once any updated Terms are in effect, you will be bound by them if you continue to access or use our Products.”

What that means: You accept new rules just by keeping your account open, without needing to click agree again.

Meta can change the terms and bind you to them simply by you continuing to use the service, provided they give some notice. There is no requirement for explicit renewed consent.

Medium cost

Indefinite retention

You are agreeing that your content license continues indefinitely until all recipients delete it.

“where your content has been used by others in accordance with this license and they have not deleted it (in which case this license will continue to apply until that content is deleted)”

What that means: Your content rights stay with Meta indefinitely as long as other users have your content.

If you share content with others, Meta keeps the license active and potentially the data until those other users delete it. There is no set end date if others retain it.
