In short

  • This agreement binds you and your business to use Stripe’s payment tools for commercial purposes only.
  • It forces any legal disputes into private arbitration and removes your right to join a class action lawsuit.
  • The service is provided without guarantees, shifting significant financial and legal risks onto you if things go wrong.

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to a jury trial and to bring claims only in individual arbitration.

“Disputes between User and Stripe are subject to a class action waiver and will be resolved by individual binding arbitration, except as stated otherwise in this Agreement.”

What that means: Users cannot sue in public court or combine their claims with other affected users, reducing leverage against the provider.

The document mandates that all disputes go to private arbitration and explicitly waives the right to join a class action.

High cost

Liability shifted onto the user

You are agreeing to accept the service 'as is' without any warranty and assume all risk for its use.

“Stripe provides the Services and Stripe Technology “as is”... Stripe does not make any, and disclaims all, warranties... and statutory guarantees”

What that means: If the service fails, causes data loss, or breaks laws, you have limited legal recourse and bear the full cost of damages.

The agreement offers no promises about performance, security, or legality, leaving the user to bear all risk of failure.

High cost

Liability shifted onto the user

You are agreeing to cover the company's losses and legal costs if your use of the services causes issues.

“User will indemnify Stripe... for all Losses arising from User’s use of the Services... gross negligence, willful misconduct, fraud, or material breach”

What that means: You face significant financial liability if third parties sue the company because of how you used the service.

You must pay for the company's legal costs and losses resulting from almost any breach or issue related to your usage.

Medium cost

Unilateral changes with little or no notice

You are agreeing to accept modifications or discontinuations of services at the company's discretion.

“Stripe may modify or discontinue any aspect of the Services... Stripe will provide User reasonable notice if the modification... would materially reduce the functionality”

What that means: Services may disappear or degrade unexpectedly, forcing you to adapt your business operations quickly.

The company can change features or stop services entirely, providing notice only when functionality is materially reduced.

Medium cost

Auto-renewal or hard-to-cancel paid terms

You are agreeing to automatic renewal of paid subscription plans after free trials or promotions expire.

“Trials and promotions may end... at which point that Subscription Plan will automatically commence.”

What that means: You may incur unexpected charges when a free trial ends if you do not cancel manually before the deadline.

Free trials or promotional periods convert to paid plans automatically upon expiration without explicit renewed consent.

Medium cost

Broad license to user content

You are agreeing to grant the company a permanent, royalty-free license to use your content for internal business purposes.

“User grants to Stripe... a perpetual, worldwide, non-exclusive, irrevocable, royalty-free license to use the Content... for Stripe’s internal business purposes.”

What that means: You lose exclusive control over your uploaded content as the company can use it indefinitely for internal purposes.

The company receives a permanent, broad license to use any content you upload for its own internal business needs.

Lower cost

Children’s data

You are agreeing that users under 18 may use the service if an adult representative takes responsibility for their actions.

“Only people 13 years of age or older may open a Stripe Account and use the Services”

What that means: Children under 18 can access the platform, though an adult is held legally responsible for their account actions.

The agreement sets a minimum age of 13 but allows minors under 18 to use the service with an adult representative.

Lower cost

Location or sensitive-data over-collection

You are agreeing to ensure that Protected Health Information is not provided to the company through integrations.

“User must not provide Protected Health Information to Stripe as part of Third Party Data.”

What that means: If you improperly link health apps, you remain liable for violations, while the company disclaims responsibility.

The agreement prohibits you from sharing health data but acknowledges the potential for such transfer via third-party integrations.

If these terms already apply to you

Keep this list. Fineprint cannot undo or cancel something you already agreed to at the company.

We cannot see Agree on their site. With Premium, tap “I accepted these terms” if you already agreed to what Stripe asks.
