In short

  • This agreement governs your use of Stripe for business payments and sets the rules for how you handle data, fees, and disputes.
  • You must use the service only for business purposes and agree that Stripe can change terms or suspend your account if they believe it is necessary.
  • Disputes with Stripe are resolved through binding arbitration rather than public court proceedings.

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to resolve any legal disputes with Stripe through mandatory, individual arbitration instead of public courts.

“Disputes between User and Stripe are subject to a class action waiver and will be resolved by individual binding arbitration”

What that means: You give up the ability to sue in public court or join other users in a collective lawsuit against Stripe.

The document requires all disputes to go through private arbitration and explicitly waives the right to participate in a class action lawsuit.

High cost

Liability shifted onto the user

You are accepting the service 'as is' with no guarantees of reliability, limiting your recovery for damages to past fees paid.

“Stripe provides the Services and Stripe Technology 'as is'... Stripe does not warrant that User’s use of the Services and Stripe Technology will be uninterrupted or error-free”

What that means: If the service fails or causes financial loss, your ability to recover significant damages is capped at the amount you paid Stripe recently.

Stripe disclaims all warranties for the service working correctly and limits its liability for damages to the fees you paid in the previous 12 months.

Medium cost

Unilateral changes with little or no notice

You are agreeing to accept future modifications to the agreement or services just by continuing to use the platform.

“Stripe may modify or discontinue any aspect of the Services... By continuing to use Services after the effective date of any modification to this Agreement, User agrees to be bound by the modified Agreement.”

What that means: Service features or terms may change unexpectedly, and you are bound by new rules simply by keeping your account active.

Stripe can change terms or features at any time, and your continued use of the service counts as your agreement to these changes.

Medium cost

Children’s data

You are acknowledging age restrictions and agreeing to involve an adult representative if you are under 18.

“Only people 13 years of age or older may open a Stripe Account... If User or User’s Representative is not 18 years of age or older... User must add a Representative who is an adult”

What that means: Younger business owners cannot use the service alone and require an adult to legally bind the account.

The document sets a minimum age of 13 but allows minors (13-17) to use the service only with an adult representative.

Medium cost

Broad license to user content

You are agreeing to let Stripe permanently use your uploaded content for their own internal business purposes.

“User grants to Stripe... a perpetual, worldwide, non-exclusive, irrevocable, royalty-free license to use the Content... for Stripe’s internal business purposes.”

What that means: Stripe can use your uploaded content indefinitely for any internal purpose, potentially beyond what is needed to process payments.

You give Stripe broad, permanent rights to use any content you upload, including for their own internal business needs, not just to provide the service.

Lower cost

Data sold or shared with third parties

You are agreeing to allow Stripe to use your name and trademarks in their sales, marketing, and public financial disclosures.

“Stripe and its Affiliates may refer to User as a user of Services in their financial disclosure documents. Stripe and its Affiliates may use User’s Marks: on Stripe webpages and apps that identify Stripe’s customers or users; in Stripe sales and marketing materials”

What that means: Your identity as a customer may be publicly used by Stripe for marketing or investor reporting purposes.

While Stripe prohibits selling personal output data, they reserve the right to use your name and trademarks in their marketing and disclosures.
