Risk score

91of 100

In short

  • This agreement sets the rules for using Stripe’s payment services, focusing on business accounts rather than personal consumer use.
  • You accept that disputes will be settled through mandatory individual arbitration and you give up your right to a jury trial or class action.
  • The document also outlines fees, potential charges, and strict limits on how much liability Stripe accepts if something goes wrong.

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to resolve all disputes through private, individual arbitration instead of public court.

“Disputes between User and Stripe are subject to a class action waiver and will be resolved by individual binding arbitration”

What that means: You lose the ability to band together with other users to fight legal battles against the company.

The document mandates that all disputes go through private arbitration, preventing users from joining together in a class-action lawsuit to challenge Stripe's actions.

High cost

Jury trial or court access waived

You are agreeing to let a single private arbitrator decide your case, giving up your right to a jury.

“All disputes... will be determined by binding arbitration by a single arbitrator.”

What that means: You cannot request a jury trial, even for serious issues like fraud or significant financial loss.

By choosing private arbitration, you automatically waive your constitutional right to have a judge or jury hear your case in a public courtroom.

High cost

Liability shifted onto the user

You are agreeing to hold Stripe harmless for most types of damages and accept the service without any performance guarantees.

“Stripe provides the Services and Stripe Technology “as is”... disclaims all... warranties... neither party will have any liability... for any indirect, consequential, special, reliance, incidental, or punitive damages”

What that means: If the service fails and causes you to lose money or business, you may receive very little or no compensation from Stripe.

The company refuses to guarantee that the service will work correctly or without errors, and it caps its total financial responsibility for any damages you suffer.

Medium cost

Unilateral changes with little or no notice

You are agreeing that your continued use of the service constitutes acceptance of any future changes Stripe makes to these terms.

“By continuing to use Services after the effective date of any modification to this Agreement, User agrees to be bound by the modified Agreement.”

What that means: The rules can shift under your feet, and you must actively monitor them or stop using the service entirely.

Stripe can change the terms of the agreement at any time, and simply using the service after the change counts as your acceptance of those new rules.

Medium cost

Unilateral changes with little or no notice

You are agreeing that Stripe can change what you owe for services as long as they notify you 30 days in advance.

“Subject to the requirements of Law, Stripe may revise the Fees and Subscription Plans at any time. Stripe will provide User with at least 30 days’ notice of any increase in a Fee...”

What that means: Your monthly costs could rise unexpectedly, forcing you to either pay more or cancel your account.

Stripe reserves the right to change pricing structures and subscription costs at any time, provided they give 30 days' notice for increases.

Medium cost

Liability shifted onto the user

You are agreeing to cover any financial losses Stripe suffers due to your usage or violations of the agreement.

“User will indemnify Stripe, its Affiliates, and their directors, employees, and agents for all Losses arising from User’s use of the Services... gross negligence, willful misconduct, fraud, or material breach of the Agreement.”

What that means: If your business activities cause legal trouble for Stripe, you could be on the hook for their legal bills and settlements.

You are legally required to pay for Stripe's losses if they get sued because of something you did or failed to do while using their platform.

Medium cost

Children’s data

You are agreeing that anyone under 18 using the service must have an adult representative who is legally bound by the terms.

“Only people 13 years of age or older may open a Stripe Account and use the Services and Stripe Technology.”

What that means: Minors can access the service only with significant adult supervision and legal responsibility attached to a guardian.

The document explicitly prohibits children under 13 from opening accounts, but allows users aged 13-17 to proceed if an adult representative is added to the account.

Medium cost

Broad license to user content

You are agreeing to give Stripe permanent, free rights to use any content you provide for their internal business needs.

“User grants to Stripe... a perpetual, worldwide, non-exclusive, irrevocable, royalty-free license to use the Content to develop, improve, and provide Services... and for Stripe’s internal business purposes.”

What that means: Stripe can potentially reuse your content internally or for improvements without paying you or asking for permission again.

Anything you upload as content gives Stripe permanent, global rights to use it for their own business purposes, not just to run the service.

Lower cost

Auto-renewal or hard-to-cancel paid terms

You are agreeing that promotional offers will automatically transition into standard paid subscriptions upon expiration.

“Trials and promotions may be subject to additional Taxes, terms and conditions... until (i) the expiration or termination of the trial or promotion, at which point the Fees stated on the Stripe Pricing Page will apply”

What that means: If you forget to cancel, you will be charged full price immediately after your trial period finishes.

Free trials or promotional periods automatically convert to paid plans once the trial ends, unless canceled beforehand.

Lower cost

Indefinite retention

You are agreeing to maintain confidentiality obligations indefinitely for trade secrets even after the contract ends.

“Trade secrets, indefinitely, and all other confidentiality obligations, for 3 years after the date of termination.”

What that means: Even after you leave, you remain legally bound to secrecy regarding trade secrets for an indefinite period.

While data retention for operational purposes is limited, the obligation to keep certain information confidential lasts forever for trade secrets.

If these terms already apply to you
